That ends the closed circuit with Newsline * * report number 857 for release on Friday, January 14, 1994. * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * FLORIDA LEGISLATION SOUGHT TO END DEED RESTRICTIONS "Deed restrictions and other Covenants work against the safety of the entire community and should be revised." So says National Amateur Radio Association President Donald Stoner, W6TNS in announcing a two prong attack against these property use constraints. First off, Stoner has filed suit against his owners association known as 440 West Inc. of Clearwater Florida. He maintains that the owners association has banned him from erecting any form of ham radio communications antenna, while at the same time violating the prohibition by having installed a community television antenna and a two way radio system for security use. W6TNS says that the ban on his installation of an antenna has violated his civil rights and impaired his freedom of speech. But Stoner believes that any solution for him will be short term. That it may not assist other Florida radio amateurs finding themselves in a similar situation. Nor will it help to set a national precedent to help hams in other states. Stoner says that this has to change even if change is made a matter of law. To that end. W6TNS has proposed legislation that will require that each condominium, planned community, and mobile home park in Florida to have an emergency preparedness plan. A plan which includes ham radio. If an Amateur lives in one of these planned communities, he or she would be allowed by law to install an antenna system suitable for providing safety communications to the community. W6TNS points out that it was not all that long ago when Florida residents had a painful, first-hand example of a communications emergency when hurricane Andrew devastated south Florida. He says that communications provided by radio amateurs was vital to the life saving effort during the storm and to relief efforts afterward. Yet he notes that many communities and property owners who owe their very survival to the volunteer efforts of radio amateurs have not only turned their backs on these communications heros. Some have gone so far as to show their collective displeasure with the very existence of the Amateur Radio service. This has to stop says Stoner and he intends to be one of the leaders in bringing about the needed change. Radio amateurs from throughout Florida and from around the nation who wish to support the Stoner's legislation should contact Richard Heiden, Esq. at Kimpton, Burke and White, Attorneys At Law, 28059 U.S. Highway 19 North, Clearwater, Florida 34621. Heiden is the attorney of record in Stoner's suit against the owners association and directs Stoner's legislative efforts in the State of Florida. If enacted, this law could become the model for hams to use in other states and possibly lead to preemption of Conditions, Covenants and Restrictions nationwide. ***** BROADCASTERS PREVAIL OVER FAIRNESS DOCTRINE A federal appeals court has handed broadcasters a win in their fight to keep the so-called Fairness Doctrine from being revived. This, by ruling that Congress never intended to make the Fairness Doctrine the law of the land when it amended communications law in 1959. The Fairness Doctrine was a rule tossed out by the FCC in 1988 that required broadcasters to air both sides of a controversial issue. A liberal Washington D.C. public interest law firm known as Media Access Project had brought suit in the U.S. 8th Circuit Court of Appeals in St. Louis claiming that Congress indeed "codified" the Fairness Doctrine in 1959. However, in a 7 to 5 vote, the court rejected the claim. The 8th Circuit's decision is identical to a ruling rendered several years ago by a Washington D.C. federal appeals court. It is important since Media Access Project and other organizations had hoped the U.S. Supreme Court would take up the question of the constitutionality of the Fairness Doctrine. Broadcasters and others who oppose the re-imposition of the Fairness Doctrine appear to be winning in their efforts in fighting the current liberal Democratic Congress that wants to revive it. Its opponents claim that reinstatement of the rule would serve to chill free-speech rights of TV and radio station operators. ***** NEW JERSEY RADIO TAX A hearing has been held in Trenton, New Jersey on a revenue enhancing bill. The state says that it wants to charge a fee for all transmitters operating in the state. The proposed regulation by the New Jersey Department of Environmental Protection and Energy, is intended to raise the money needed to enforce a 10 year old state law restricting excessive RF radiation. At least that is how the state sees it. Virtually all of the speakers at the January 11th public hearing viewed the proposed fees to be levied on transmitting antennas as nothing more than a tax on Federally licensed transmitters. Department officials had promised to exempt hams, but the proposal itself didn't do that and comments were invited on the possibility of regulating hams in the future. ARRL General Counsel Chris Imlay, N3AKD came to Trenton from Washington to argue that only FCC had the legal power to regulate hams. The ARRL Section Manager for northern New Jersey Rich Moseson, NW2L, explained how such a regulation with fees averaging $250 per antenna would virtually shut down amateur radio in the state. The league asked that a specific exemption for hams be added to the proposed regulation. Several other hams testified as well. ***** CALL SIGN ADMINISTRATOR PROGRAM DEAD The FCC has withdrawn an order issued in May 1993 establishing a club and military recreation station call sign administrator program. The FCC said that its newly proposed vanity call sign program will be administered by the Commission itself, would make the volunteer administrator plan unnecessary. The FCC also noted that a Petition for Reconsideration of the administrator program, filed in June 1993 by David Popkin, W2CC, had merit. Popkin said that contrary to the FCC's Order, establishing a call sign administrator program IS controversial, and should have been subject to a notice and comment rule making proceeding. The FCC granted Popkin's petition. The FCC will return applications to be call sign program administrators to the parties concerned, without action. ***** YOUNG HAM WINS CONTEST TO SEE SHUTTLE LAUNCH When space shuttle Endeavor lifts off on April 7th, an 8th grade youngster from Staten Island New York will be at Cape Canaveral to watch. Rene Hoehn, KB2QMR, has been chosen by the faculty of the Rocco Laurie Intermediate School to be there after winning an essay contest. "When I received the invitation to attend the launch I was all excited, and I was more excited when I found out I was allowed to bring people with me. My immediate family, of course, got the first couple of invitations, and then I decided to throw it open to my other children and that's the children I teach amateur radio to at my schools. And what we did was we had a little essay contest that I opened up to my amateur radio classes, all thirteen of them. And each child who wanted to participate in this and get to witness the shuttle Endeavor going up and who wouldn't had to tell me why I should pick them. Why they wanted to go." Carole Perry, WB2MGP Carole says that she decided to limit the contest to only her ham radio students for several reasons. "The reason I restricted it to my ham radio kids was I wanted the other school, the rest of the school population to realize the really neat things that can happen to the children who are in fact in contact with people like astronauts on ham radio. And so it brought school-wide attention to the fact that these were really lucky children indeed and heighten awareness once again in the space program, which is another objective of mine at the school and showing all the neat stuff you can do with ham radio." Carole Perry, WB2MGP. Rene Hoehn was selected by a committee of judges that included the Principal and Assistant Principal of the Rocco Laurie School as well as Carole Perry. The trip to the STS-56 launch will not be the first special school event that KB2QMR has attended. WB2MGP says that Rene is student who gets involved. "This youngster has participated in other events with me like Ocean Challenge last year. Where she got to meet Rich Wilson the amateur onboard the Ocean Challenge sailboat. She came with me to the sea port to meet him cause she had spoken to him on the radio. Among its crew members will be Astronaut Jay Apt, N5QWL. ***** NASA TV CHANGING BIRDS NASA Select television has moved off of its long time home on GE Satcom F2R. NASA Select is the space agency originated television service available to TVRO owners and local cable television systems. Their new home satellite is GTE Spacenet 2 on transponder 5. This is a C Band bird parked at 69 degrees West longitude. Transponder 5 is on a frequency of 3880.0 MHz, horizontal polarization. NASA audio is on the 6.8 MHz subcarrier. NASA Select Television service offers daily educational and informational programming, carries Shuttle launches and mission coverage, and occasionally airs live coverage of Shuttle Amateur Radio Experiment or SAREX operations. The move to Spacenet 2 was scheduled to take place at 15:00 UTC on Saturday, January 8. ***** CONTEST VIDEO CQ Communications has released "Getting Started in Contesting" the latest in its 'getting started' video series produced by Emmy award winner Rich Moseson, NW2L.
